9:45am-10:45am – Property Condemnations:  The Engineer’s Role in Legal Cases

When a property, or a portion of a property, is taken by eminent domain, the value of the property taken is often at issue.  Condemnees frequently are offered less than the property is worth and may take legal action, which involves production of reports by expert witnesses.  The condemnee’s attorney will engage an engineer to prepare a report, which may include plans, calculations and exhibits, to demonstrate the development potential of the property, from which an appraiser determines a value.  We’ll look at several property takings in which we served as the engineering expert witness, and go through the process from engagement by the attorney to resolution of the case.

11:00am-12:00pm – Phase II Environmental Site Assessments: Charting a Path to Success

This presentation will cover the purpose, goals, and methodologies of conducting a Phase II Environmental Site Assessment (ESA). Phase II ESAs are typically conducted in follow up to a Phase I ESA in order to satisfy a lender or potential purchaser, if evidence of potential impact or Recognized Environmental Conditions (RECs) are identified by the Phase I ESA. The Phase II ESA should include a detailed scope of work to further evaluate identified RECs through intrusive investigation, such as geophysical investigations, test pit investigations, soil borings investigations, and the physical sampling of Site media (ie. soil, groundwater, surface water, and vapor).  The presentation will cover the various work scopes typically included within a Phase II ESA, and will discuss the importance of proper Phase II planning, as it affects the project and client objectives. In addition, the presentation will discuss the importance of frequent client communication, which is needed to provide time-sensitive recommendations and guidance. Lastly, we will discuss the various Phase II outcomes and what impact they may have on real estate transactions and land development plans.
